The Americans with Disabilities Act (ADA) requires employers with 15 or more employees to provide reasonable accommodations to qualified individuals with disabilities, unless doing so would cause undue hardship. This includes modifications to work schedules, job duties, equipment, and physical workspace.
The IRS and most states use a multi-factor test to determine worker classification. Key factors include how much control the employer has over how work is performed, whether the worker uses their own tools and sets their own hours, and whether the relationship is permanent. Misclassification can result in back taxes, penalties, and benefits liability.
Earned wage access (EWA) lets employees access wages they’ve already earned before the standard payday. It’s not federally required, but some states are beginning to regulate EWA programs. Employers often offer it as a voluntary benefit to improve retention and financial wellness.
