Overview

New Mexico uses the federal W-4 form for withholding purposes, making setup convenient for employers. The state’s progressive tax is administered by the Taxation and Revenue Department. 

What Makes New Mexico Unique: New Mexico has a progressive income tax with rates up to 5.9% and uses a state-specific withholding table. The state also has strong protections for employees under its Human Rights Act.

State Income Tax (SIT)

New Mexico uses a progressive income tax with brackets based on filing status. The state aligns with the federal W-4 form, so there is no separate state withholding form for employees to complete. Filing status is taken directly from the federal W-4 Step 1(c), and additional deductions can be specified using Step 4(b).

Supplemental Wages

New Mexico supports the following supplemental calculation methods. Supplemental wages such as bonuses and commissions will be calculated using the applicable method.

Employer State Unemployment Tax (SUTA)

Your assigned SUTA rate will be based on your company’s experience with unemployment claims. New employers typically start at the default rate of 2.0%.

How to Set Up New Mexico Payroll Withholding

Follow these steps to begin withholding New Mexico payroll taxes for your employees: 

  1. Obtain your Federal EIN at irs.gov
  2. Register with the New Mexico Taxation and Revenue Department at tap.state.nm.us
  3. Register for SUTA with the New Mexico DWS at dws.state.nm.us
  4. Employees use the federal W-4 for New Mexico withholding
  5. Submit a Netchex tax team request to enable New Mexico SIT and SUTA
