Keeping Form I-9 documents isn’t just a filing exercise—it’s your first line of defense in an immigration audit. The Department of Homeland Security (DHS) and Immigration and Customs Enforcement (ICE) have shifted enforcement toward employer audits, and the quality of your I-9 documentation directly determines your liability.

How Long Must You Keep I-9 Forms?

Employers must retain Form I-9 for each employee for the longer of three years from the employee’s hire date or one year after the employee terminates. For rehires, you may use the same I-9 if the employee is rehired within three years and certain conditions are met (otherwise, create a new Section 3).

Storage and Access Requirements

I-9 forms must be stored in a manner that’s immediately available for inspection upon request. Many employers keep I-9s separately from general personnel files to ensure they aren’t accidentally destroyed during routine record purges. Digital scans and cloud storage are acceptable, but the original or a certified copy must also be retained.
